is already signaling the anti-trump tone his campaign is going to take where a

state where we don't criminalize diversity we celebrate diversity we

invest in children just sessions invest in children where we don't tear them

from the loving arms of their mothers and their fathers but now California

voters who may actually like President Trump have a candidate for governor

themselves John Cox and it wasn't Donald Trump that passed the sanctuary State

now voters have a few more months to decide how they want California to be

some grand aspirations here he has taken a pledge that he's not gonna run for

recent years because the combination of the massive gas and tax increase

gasoline in parts of California is now $5 a gallon the sixty five percent of

Californians say that the state's too expensive in terms of cost of living

yeah Newsom is running with a commitment to

both raise the income tax and raise the property tax and he's proposing to have

a government-run health system which will be wildly expensive so I think if

cops can penetrate with a message just about the cost of being in California

and that Newsom is the problem and if he can take every Newsom attack on Trump

and turn it back into a let's talk about California so I think this could become

a much closer I wouldn't get too excited about that one gavin newsom you were

pointing us out tweeted in response to Donald Trump's tweet about good night

for California he says please come campaign for him Donald Trump as much as

possible bill hemmer interview this morning with mr. Cox and I would just

say this he can do the things that you're talking about because we watched

him do it live on Fox News this morning I mean he he talked all about that

spending and the legacy of that spending and the problems with that spending

right now in the context of questions about sanctuary cities and all of that

sort of thing and he did that pivot from the criticism on the president that

you're talking about so I know it's it's one interview it was the first one that

I've seen of him live since you know kind of taking on Newson

um but it's interesting I mean News and as part of that apparatus in California

that's very tough to beat well it'll be interesting to meet cards

there there are a lot of Democrats in this state yeah I've Newsom has already

won a state white race he is the lieutenant governor he's incredibly well

known he beat Antonio Villaraigosa who should have been a formidable opponent

Antonia velar goes to out Spence John Cox and it didn't matter he didn't

even get half the vote yeah that Cox got so you know is it just a foregone

conclusion for Newsome or does he actually have to run closer to the

middle to get some of those counties who don't like his San Francisco past or his

support for things like the Train of nowhere the high-speed train that's not

high speed and it does not connect LA with San Francisco I mean California is

a democratic state the head wins against someone like the Republican candidate

for governor are incredibly strong and just from a you know numbers game there

are a lot of Democrats and these are liberal Democrats in California now what

was interesting is in California in parts of California but what was

interesting is Dianne Feinstein I have a lot of military families faces everyone

want a usability and and that's right practical addressing a vision everyone

was saying that Dianne Feinstein was gonna have the serious challenge from

this very very liberal Democrat that ran against her who got like 10 percent of

the vote so yes California is liberal but I

actually do think there's a more moderate Democratic Party that still

voted almost 50% for Dianne Feinstein that will help Newsom there just aren't

enough Republicans especially if if Cox aligns himself with Donald Trump who is

incredibly unpopular even among California Republican okay but I will

say this about Cox if he actually can run the kind of campaign in the general

that he's talking about which is civil and race issue based he can reach some

of those more conservative Democrats and there are a lot of independents and Cal

people that don't want higher taxes don't want to live in sanctuary cities

there are a number of them in California I would really love for this fight to be

competitive between Cox and Newsome I think it'd be just interesting for the

country to watch but I think the midterms and Speaker you can speak this

as well it's gonna be a lot about Donald Trump you're gonna have the Democrats

many of them running against him and the Republicans wanting to side right with

second place and will have an uphill climb to take on Republicans in November

Rohrabacher and Mimi Walters both of them are progressing to the general

election but Senator Dianne Feinstein is breathing a big sigh of relief from DC

because she made it through a very contested primary and is heading to the

general election in November but she wasn't in California last night Steve

Department of Justice and the FBI that no one good for him and his bride and

his lawyer says if he doesn't get immunity he's going to plead the fifth

right so if you please fifth and he could get subpoenaed and

then we could that could be an issue they just go down the line bottom line

they don't the Judiciary Committee and Grassley got the letter would have to

make that decision do we give him immunity because he's looking at a lot

of legal trouble number one and number two what would he say so they do have

these preliminary meetings before it's a if I community let me know what you're

gonna say and it's one of the things I want to say is what the you and James

Comey cannot be telling to say that they felt by telling the truth because you

liking him caught on tape saying that his administration is a disaster and it

so the big news out of last night John Cox Republican going up for governor I

think it's a sign that there are a number of people in California that are

wanting some real change well you know we didn't expect huge victories in the

state of California at least for the Republicans we knew that that wasn't

going to happen but seeing a Republican on the ballot for governor especially

with the way that this state runs its primary is significant for us and it

also shows that a Trump endorsement works even in the liberal state of

California a trump endorsement means something I believe it has a lot to do

with immigration also taxes regulations but moving forward we're gonna have to

fight but we're ready to do it well one of the things Tommy is I know

Republicans had worried that unless a Republican finished in the top two it

would be to Democrats for that big state office and then with the other

congressional races and stuff like that what would turn people out thankfully

for the Republicans they said last night we've got a Republican at the top and so

people are going to go out and vote and it's gonna be better for us and maybe

that blue wave might be actually a little red well what I hope that last

lot yesterday and today and ongoing is going to show Republicans in this state

is that we have to turnout we have to be vocal we have to make sure that we're

voting we succeeded yesterday and making sure that we have John Cox on the ballot

making sure that we can propel him forward but that doesn't mean that the

fight is over we have to continue he has to make sure that his messaging is very

clear to Californians we want to make a change I think we're gonna do it it's

gonna be a tough battle we know in this state Gavin Newsom is gonna be the

favorite but we have a chance for first time in a long time we have a chance

well here's the thing in terms of the house there's about seven content area

contentious fights there and a lot of people believe the house will go

Democrat or Republican depending on what happens in California with Daryl I so

seat and Dana Rohrabacher seat and so far the jungle primary has not yielded

solid Democrats who were solid Republicans for that but it got quite

close because there's so many Democrats who felt as though they wanted to run

for that seat it diffused a la of the votes so it allowed war backer

and others to stay up top yeah perhaps they got a little too excited with their

blue wave and it actually ended up helping out some Republicans but hey

there are some things in the state that we can look at the small victories we're

going to take we have a California state senator who was facing recall because of

his vote for again a higher gas tax so that just shows that Californians are

upset with the high taxes were upset with failed immigration policies and no

border enforcement we're tired of over-regulation we're tired of

unaffordability so this is a good sign small victories but we'll take them all

right tell me a lot of folks the media been having a field day about where on

earth Melania Trump is and we might have just hit rock bottom with one reporter

from The Rolling Stone Jamil Smith we just read you his tweet he says I wish

that I didn't suspect that the prolonged poorly explained public absence of

Melania Trump could be about concealing abuse I wish that it was a ludicrous

prospect I wish that the president wasn't a man with a history of abusing

women including those to whom he is married no sources nothing to back this

up welcome to 2018 by the way that's not true but go ahead right well we hear

journalists we hear the mainstream media often complain that drunk attacks then

that Trump goes after them that they're losing credibility because of this

president no I'm sorry they're losing credibility because of things like that

to advance something so ridiculous like that and put that out there with no

sources no facts just to speculate on that that's the reason that the American

public does not trust the mainstream media does not trust journalists to put

something out there like that I don't care if you're anti Trump that's one

thing but when you go as far as to say that Melania might be abused and that's

what we haven't seen her in a while and she's just suffered an illness and a

surgery that's ridiculous and I hope the American people are looking at this and

watching it as a further again Trump derangement syndrome

yeah and just real quick what what would happen to that writer if they had said

that about Michelle Obama well that writer wouldn't be working any

more there would be an outrage over this began we know that the double standards

the only standard the left operates on and they're really hurting themselves at

so many accomplishments almost every 24 to 36 hours there's another one since

he's become president all these little things hundreds of them people could go

through and see the media doesn't talk about those things do you see and the

media can spin up all these stories they want but what's funny about it the more

they do it the more Trump continues to rise well this coming the same day White

House press secretary Sarah Sanders got into a tense exchange with reporters

grilling her about the drafting of the Trump Tower memo and questioning her

credibility here's how she hit back watch frankly I think my credibility is

probably higher than the media's I think that if you spent a little bit more time

reporting the news instead of trying to tear me down you might actually see that

we're working hard trying to provide you good information and trying to provide

that same good information to the American people you know speaker there

has been talk recently about whether we even need White House press briefings

every day that maybe some of them should be in an office and not all televised

because it looks like some of the reporters might be doing a little

grandstanding I can't even imagine that look I advocated but the very beginning

of this administration that they just get rid of the whole thing really

here's what I mean when I say you're the whole thing you have a relatively small

number of reporters who are important because they're in the White House and

they're very precious and they sit around on top of each other all day and

deep down they resent the fact that their voice they're at the beck and call

of the president existed or just as much existed for at least I think since

Kennedy television my point just you know there are a thousand ways to

communicate with the American people you don't owe the American people having 50

or 60 women you have three or four clowns who insist on getting in fights

with her and they're only important because they get in fights with her on

social media because they can clip that piece of video and it becomes clickbait

and and look if anybody doesn't think that's happening check out some 12

point you know I understand that every politician wants to get their side of

the story out that that's a natural inclination I rolled my eyes when

Hillary Clinton did it and I don't think it's necessary here to have a website

for that the president has been very adept at using Twitter for that he's got

over 50 million Twitter followers and you know he essentially directs the

media wherever he wants them to go and I like these exchanges I like any sort of

an open forum where the ideas can get out I also like that I think Sarah

Sanders does a very good job at keeping us tight and swatting people down I

think she's got an incredibly difficult job and it's easy for certain people in

that room to gang up on her and I think you know her comportment is actually

much better than some of the people who preceded her not just in this

administration but in others but for the reason that she's there that long I

think speaks it to how good she's been they have it the reporters have every

right to ask about certain questions like that Don Jr meeting why were they

dishonest from the beginning I think the rates and balances is an important thing

but there's also something else going on and you make that point Speaker that

they are such a rush to find all the negative that the president is doing the

perfect example was April Ryan yesterday they threw this birthday bash when the

Eagles when he disinvited them from the White House on the South Lawn and she

tweeted out that they were a bunch of booze to the president she had to delete

that tweet because it wasn't accurate but in the moments that that tweet was

up there were thousands and thousands of retweets because people wanted to

believe that narrative they wanted to know that something was bad against the

person has a credibility problem that she should answer for all right we want

to break in with us now we knew that this was coming together Fox News has

confirmed that Alice Marie Johnson who was serving a life sentence for a

nonviolent drug crime her sentence has been commuted that is different than a

pardon in just the specific way that life sentence will wipe away and she

will go free however a pardon would have completely wiped away any conviction and

given her full forgiveness the president has been on kind of a roll for pardons

and the sort of thing I want to ask the speaker about this do we have time

before the commercial break okay speaker you're a response well I think that the

president has found something he likes to do that

proves the lives of people and that clearly is his constitutional authority

and I think that he takes a certain personal pleasure in being able to help

where he is just over the board and at least 10% I'm

hurting himself there's this very big difference in the

two ways he approaches things all right very good

here's harris faulkner let's begin with what's developing this hour new

questions for James Comey ahead of a bombshell inspector general's report

will go out number two overtime now i'm harris faulkner

the Justice Department's internal watchdog has reportedly concluded former

FBI director James Comey defied Authority at times during the Hillary

Clinton email investigation what does that mean it is according to ABC News

which says the draft report explicitly uses the word insubordinate to describe

James commies behavior all this is fired deputy FBI director Andrew McCabe is

seeking immunity from the Senate Judiciary Committee in order to testify

on that inspector general's report we'll hear from a house from a member of House

Judiciary Committee congressman Matt gates in just a moment first I want to

get all the news that's been happening in the last hour or so chief

intelligence correspondent Catherine Herridge breaks it all down Catherine

well thank you Harris Fox News is working to independently confirm that

report that the Inspector General did find evidence that former FBI director

James Comey was found to be insubordinate and went outside the chain

of command based on our ongoing reporting we understand one of the

primary episodes the Inspector General was investigating was his decision in

July of 2016 you see the event here where you did just a moment ago to

publicly announce the findings of the FBI investigation that used the code

acronym my E or mid-year exam and that he was recommending against criminal

charges that's the key development there because typically that decision would be

under the purview of the attorney Loretta Lynch but that was a

responsibility that your director Comey took upon himself also in a separate

development Fox News has obtained these congressional letters that show the

former FBI deputy director Andrew McCabe who worked directly for James Comey

wants a special status if he testifies before the Senate Judiciary Committee

later this month about that same Inspector General's

report this special status is called youths immunity and under those

conditions McCabe's testimony cannot be used

against him in a criminal prosecution that matters because the Inspector

General found that McCabe lied under oath and there was a criminal referral

to the US Attorney here in Washington DC for potential violations of 18 USC 1001

that's lying to federal investigators this morning a senior Senate Republican

who sits on the Judiciary Committee recommended against a deal to secure

McCabe's testimony we really need to get to the bottom of what happened at the

FBI during the Comey years where apparently

there was misconduct going on which i think is really important for sment

agency in the world and we need to clear the air and so I think giving mr. McCabe

cover through immunity would be a mistake

McCabe's lawyer said in a quote McCabe is willing to testify but because of the

criminal referral he must be afforded suitable legal protection adding that if

he were unable to get such a deal McCabe will have no choice but to invoke his

Fifth Amendment privilege against self-incrimination based on the timing

this continues to be a very fluid situation as you know Harris there is a

date on the calendar for Monday next week for open public testimony in front

of the Senate Judiciary Committee that's the lead committee for the inspector

general's report but based on what we've learned in the last 24 hours it does

appear that that date is likely to slip yet again Harris well and we've seen

some delays Catherine and lawmakers that I've been talking with have said you

know they want a chance for that report to come out obviously before they would

hold that here and so they'll does a way to if I can just yeah just a warning

based on what we know it's a very lengthy report somewhere in the

neighborhood of 500 pages and people who sit on the

San Judiciary Committee field they need at least a couple of days to adequately

comb through the report they so they can add asked great questions for the

inspector general Horowitz and he can defend appropriately defend his findings

here ensure interesting 500 pages depending on how much of it leaks okay

right now we're wrong nothing and I just if I could say one other thing on that I

I think that's pretty significant because we're in a phase right now where

the principal's who cooperated are allowed to review the findings and then

make their case or their best argument against what the conclusions are I think

one of the key things is that we haven't had a lot of leaks about the findings

and the parties who would have that information may feel that it's pretty

damaging and they're trying to you know shape the outcome to the extent they can

with their version of what happened it's very interesting I'm gonna bring it up

with my first guest Catherine great well thank you

Republican congressman Matt Gaetz of Florida sits on the House Judiciary

Committee boy this story has come together quickly and Catherine Harridge

and I you may have heard we're just talking about the leaks that helped

bring this about let's start with the word insubordinate

that apparently that we've learned about James Comey through these leaks

insubordinate from that inspector general's report what do you make of it

well I am eager to discuss that Harris but first if you'll afford me a

privilege I am the son of a military brat and in my district we have more

members of the active-duty military than any other congressional district in

America and your new book will ring true in their lives and I just wanted to

thank you for it how military brats can meet challenges and adversity with grit

and determination it really is going to be special for my family and for so many

families in my district as it relates to mr. Comey obviously we've seen

circumstances where he's exceeded his authority we also can't make sense of

his public testimony that he had not made a decision on the Hillary Clinton

investigation until after conducting the key elements of that investigation later

we find out that drafts of his exoneration statement were done earlier

but look at Washington DC was the swamp and

McCabe might be the Loch Ness monster of the swamp and when we look at what he's

doing now I mean Andrew McCabe is literally asking for immunity before

testifying under oath so that he's not prosecuted for a whys that he told

previously while testifying under oath I think it would be outrageous for us to

grant any type of use of immunity to mr. McCabe I think he needs to account for

his actions and I don't think that he's out of the woods yet as far as a

criminal prosecution well first of all thank you for the comments on the

military brats in my book I'm very grateful

III do want to talk though about this idea and I wrote it down you said McCabe

might be the Loch Ness monster of the swamp why do you think it is he would

try to put himself in a position where he could talk without immunity if he had

planned to tell that I mean has he been dishonest is there a reason why he'd be

seeking it well Andrew McCabe is a proud guy that doesn't make him an honest guy

I was in the room when he gave testimony behind closed doors to the House

Judiciary Committee and I could tell you my reaction to that was that this is

someone who wasn't purely engaged in the investigative work of the FBI he was

trying to shape public opinion remember Harris what the substance of

the lies were about he was leaking to The Wall Street Journal about the nature

of the Hillary Clinton investigation wanting to shape public opinion and so

Andrew McCabe may want to testify to again try to shape public opinion but we

should not give him immunity because my goodness this was the very

person who sent the email taking the jurisdiction away from the Washington DC

field office and bringing it to the rest of the swamp creatures and deep state

folks at the headquarters of the FBI I think we ought to stand with the front

line FBI folks and empower them not empower the bureaucrats that want to

shave public opinion through leaks you know you talk about Andrew McCabe as the

guy who might have some answers though because remember when James Comey first

came out on his book door we learned from a cave that they maybe weren't in

agreeance about what really happened with going to the media and leaking

things perma cave that he said his boss knew all about that so are you missing

an opportunity by not offering him that that special status of immunity to have

him turn on his boss potentially with some information that you might need

well I don't want to make the same mistakes the Obama Justice Department

made remember the Obama Justice Department gave these broad immunity

deals to Cheryl Mills and Heather Samuelson those folks who were key

Hillary Clinton allies so we want to get away from that environment so that we

could truly hold people accountable we're gonna have to get to the emails

and I want to specifically know who told Andrew McCabe to send the email telling

the Washington DC field office to stop working on the Hillary Clinton

investigation was that James Comey was it Andrew McCabe himself did it have

something to do with his wife's campaign for political office so we do still need

answers but we shouldn't be trading immunity to get those answers that was

the mistake of the Obama Justice Department look at congressman I know

it's across chambers but we are waiting to see what's going to happen with that

Senate Judicial Committee hearing and just to give you a last word on this

this is getting pushed back yet again that inspector general's report

I know it's leaking will you get an opportunity to see that before everybody

else I shared the president's concern that the actual substance of the report

has likely been written for some time now you may have people trying to sand

off the rough edges and make it look like the conduct was more acceptable

than it should have been so the president expressed that concern in his

tweet yesterday based on some of my own sources I share that concern and that's

why we're pushing to get the information out in the public as soon as possible

and if people are behind the scenes changing the substance of that report we

will find them remember we caught the folks who changed the hillary clinton

exoneration statement and if there are folks that are engaged in that improper

behavior we'll catch them again congressman Matt Gaetz the great state

of Florida thank you very much and again thank you for your kind words about my

let's bring in Fred TC former federal prosecutor and former assistant US

attorney general and the criminal division my first question for you with

regard to all of this is insubordinate a legal term you know it depends on how he

was insubordinate I mean I think if I have the FBI so right right

so if his insubordination was that he broke the law and leaked things that he

shouldn't have or did things that he shouldn't have then the answer is yes

it's a legal term it's an euphemism for he broke the law in my opinion all right

I I'm watching out of the corner of my eye and we may pop this up on the screen

- we've been waiting for a White House press briefing by Larry Kudlow and when

that happens talking about the economics of the g7 summit we'll go to that live

so let me just get that in there real good right so yep you know Fred when you

look at all of the Inspector General's report and week haven't seen it yet

just stuff is coming out and leaking what are you as a legal professional

looking for well I'm looking for a lot of things I mean minoo at a federal

prosecutor one of the things you don't want to do is give immunity if you can

avoid it because it really hurts you I mean I had a case involving two fAA

officials in an entire airline and we had to give immunity but you don't want

to give immunity until you know what's going on so the answer to your question

is what I'm looking for from the IG report is what are the facts what are

the information I need any type of prosecutor needs to make a reasoned

decision because you know what Harris what's the endgame in my opinion the

endgame should be to make sure that people stand accountable and are

prosecuted to the full extent of law if they broke the law and how complicated

is it for that accountability because we don't see it a lot in our federal

government so you see the chasing of the facts right now the Inspector General

seems to be able to multitask he's also looking at the Hillary Clinton

investigation so on and so forth right and so you know what Harris I mean it

part of my frustration over years is is is it seems to me and I think it seems

to a lot of outside observers that maybe the law is not getting followed and that

needs to end I mean the public has to have confidence in the DOJ and the FBI

when I was a fellow prosecutor you know proudest day in my life was when I put

my hand on the Bible and became a prosecutor and my job is to uphold the

law irrespective of my political convictions and the FBI that I worked

with I never saw any of this stuff kind of these allegations that you're seeing

so so the endgame takes on a couple of things and the prosecution people need

to be held accountable for what they did not from a political standpoint there's

no room for politics in any of this on either side there's the law

and there's the conduct of the people that engage in activities that may have

broken the law and there's justice to be answer to those are what count Fred does

what we are learning and again this is drip drip because it's it's being like

the report so we're gonna have to wait another few days potentially even next

week before we know all of it or or might we may never know all of it but

we're hoping to know all of it so my question to you now is with this

inspector general's report do we wipe away the thought of a second Special

Counsel to look into things like how the Hillary Clinton investigation into that

private server when she was Secretary of State how that came about if there were

any laws broken I mean does this answer back is this IG doing a good enough job

or a deep enough job just from what we've seen on the surface you know this

ID has a tremendous reputation so far the reports that I've seen from him are

fair and balanced to coin a term you know the question is what are the facts

and as you say we don't have all the facts but I only have half the facts and

the surefire way to get in trouble is to go forward with half the facts we've

already seen that in one Inspector General's report you know one one

special prosecutor's appointment I am personally loath to see special

prosecutors get appointed but you know at some point we've got to return the

confidence in the public and the transparency in these institutions and

if getting a special prosecutor one who's above reproach to come in and do

the right job and do that and and make sure that people are held accountable

for what happened that would go a long way to to saving the reputation such as

it is of the DOJ and the FBI at this point all right ahead of that report

again we are looking at leaks how much does that complicate because sometimes

it can start a narrative about a certain situation as an attorney I know you

don't like to see things leak but but when you look at this what does it

really do to the evidence in a case and I call it a case because that's what

we're looking at right we are looking at occasion and and it compromises your

ability to prosecute a case I mean again these leaks are driven by political

people with political ambitions that's the only reason to leak things I mean

the federal grand jury rules requires secrecy now put aside whether or not

we're we're talking about indictments anything

like that will succeed the federal rules of Criminal Procedure make it very very

clear you're not to leak anything and and I will tell you and every person in

law enforcement will tell you that leach don't help the investigation in any way

shape or form they tip off people in the way the prosecutors and the

investigators may be going they do a lot of really bad things that's why by the

way it's against the law to leak this stuff and so it troubles me when I see

it Fred TC we appreciate your perspective and legal

What Is Happening with the California North Bay Fire Litigation Cases? - Duration: 3:01.

Hi, my name is Ian Barlow, I'm a partner at Kershaw, Cook & Talley, and we want to provide

you with an update on the California North Bay fire cases, which is litigation related

to the approximately 15 fires that started in early October 2017 - that claimed the lives

of over 40 people, injured several others, destroyed 245,000 acres of property and over

14,700 homes.

These cases have now been consolidated and coordinated in what's called a Judicial Council

Coordination Proceeding or a JCCP.

These cases are pending in San Francisco County Superior Court before a single judge, Judge

Carnot.

On March 6th, a case management order was entered or CMO, laying out the framework for

the litigation, setting out the stages of discovery, and identifying the various plaintiffs'

groups that have filed claims and cases in the litigation.

The various plaintiffs include: individual plaintiffs, such as individuals and business

entities harmed by the fires, public entity plaintiffs including counties harmed by the

fires, class-action plaintiffs who filed class actions in litigation, and subrogation plaintiffs

or insurance companies that are seeking economic recoveries for monies paid to insureds.

Master pleadings have now been prepared and filed in a litigation and PG&E has now answered

those complaints.

PG&E has also filed a challenge to those complaints in the form of what's called a demur and the

demur has now been fully briefed, where the plaintiffs have filed oppositions to the demurrer

on April 16th 2018, and PG&E filed a reply on April 30th 2018.

The CML also sets forth the stages of discovery.

The first stage of discovery is related to liability issues and damages that were suffered

by the plaintiffs.

The second stage of discovery will focus on expert discovery, where experts will weigh

in on those liability issues and damages.

The next step in the case is for hearing to be conducted on May 18th at 9:00 a.m. where

the Court will hear PG&E's demur as well as set a new date for the next case management

conference.

Also at this hearing, we expect that the parties will report out on the status of discovery

as well as report out on whether or not any additional parties need to be added to the

litigation.

highly anticipated Department of Justice internal watchdog report ABC News is

reporting the DOJ Inspector General Michael Horowitz has concluded that

James Comey defied Authority at times during his tenure as FBI director it is

breaking now this is outnumbered i'm harris faulkner here today co-host of

Fox and Friends weekend Abby Huntsman host of Kennedy on Fox Business Kennedy

former deputy spokesperson for the State Department Fox News analysts and host of

Benson and harf on the radio Marie harf joining us now in the center seat former

House Speaker and Fox News contributor Newt Gingrich also the author of the new

book Trump's America the truth about our nation's great comeback he is

outnumbered as we say we have a lot to get to this is breaking right now and I

am definitely outnumbered this new thing is amazing yeah let's get to it

a former FBI director James Comey reportedly in hot water as we await the

release of that DOJ inspector general's report it's been delayed we've been

reporting that one day horse is telling ABC News the watchdogs draft explicitly

uses the word insubordinate to describe commis behavior during his time as head

of the FBI the draft also reportedly criticizes former attorney general

Loretta Lynch over her handling of the Hillary Clinton email investigation

this is meaty we knew that there'd be some fireworks with this IG report from

what everybody was telling us what's your first reaction the first reaction

is somebody inside justice decided they would leak this because it I don't think

it's gotten anywhere except in the Justice Department and that means

somebody inside justice is really angry about the way it's being handled and I

think they've decided let's just start getting it out there any sort of

surprise reaction par for the course with James Comey from you I don't know

that I have any surprise about look I think that Comey

was a terrible person who did terror things I think he did it in the Bush

administration I think he did it when he's head of the FBI and I think that if

McNabb gets immunity and testifies that Comey will be in even worse shape and I

think both McNabb and Comey have enormous legal liabilities

you mean Andrew McCabe former general care of the FBI who was fired with four

different charges of having broken the law and so you have the top guy at the

FBI fired the number-two guy at the FBI fired the support apparently says the

Attorney General was doing things that were wrong which which I believe means

you eventually gonna get to Valerie Jarrett and Barack Obama yeah okay so

that's where I want to go with you Marie harf so now you have if you will that

that line of command which would reach all the way to the president to the

White House potentially maybe I mean first of all first of all it's a draft

report so we have no idea if there are caveats we have no idea the context and

we're all gonna have to wait and read it together when it's finalized but I think

that I've always said about Jim Comey he is by no means a perfect public servant

I think he has done damage to his reputation and a lot of Democrats hate

him too that being said some of the criticisms he has raised can also be

true so we have to sort of separate those out when you like what what are

you talking some of his criticisms of President Trump and I think the fact

that President Trump fired him in part because of the Russia investigation can

still be problematic even if Jim Comey wasn't perfect but you

asked about Barack Obama we have no idea I mean we have no idea

what Jim Comey was doing or if he was talking to Barack Obama talking to

anyone in the White House I don't even know why you brought up Valerie Jarrett

she hasn't been a part of any of this so I think we just have to take a deep

breath and wait till we see the report I want to get the speaker a chance to

respond I mean first of all you do have the specific text message in which one

of the FBI agents says to the other the president personally wants to be kept

brief than all this second on the election meddling investigation on on

the investigative well on the investigation into the Trump campaign

during the election second you know just the way the White House operated the

idea that Valerie Jarrett wouldn't be in the middle of this is in conceiving you

have no evidence she is you're just throwing that out

there I have no idea if she was why would I want to get back to something

else I mean what's interesting here is you've got the three essentially top

players and justice and FBI turning on each other because Andrew McCabe and

think how liberally the FBI was handing out immunity during the Hillary Clinton

investigation so Andrew McCabe assumes that he's going to receive the same sort

of liberal outreach I don't think he's going to I don't think he needs to be

immune from prosecution but what he's saying is I will gladly turn on Comey

Comey has said there's classified information about Loretta Lynch that

showed that she directly meddled in the investigation and Comey has also you

know he's tried to say that he and McCabe were best friends but you know

perhaps he wasn't as honorable as people have thought but you know it'll be very

interesting to see where we go from here because if you know if you believe James

Comey and it's fine to do a reductio you can you can go ahead and believe James

Comey at his word when he says that Loretta Lynch was so compromised he had

to go Loeb he had to go out on his own which contradicts his testimony that he

believes in chain of command but if he really believed that that means he

couldn't go to the president he couldn't go above her to you know the chain of

command above her and appealed to the President and say she's doing something

wrong so he went out on his own person who might've leaked to information about

his conversations with the president to a friend whom he had employed at one

point as head of the FBI as a special type of agent at the FBI he leads to

that Columbia professor that person were supposed to suspend belief about

everything else that he's telling the truth and and not think that that any of

what you said happened it's it's a stretch perhaps for some people

politically I want to get to this though the word insubordinate apparently is

used by the Inspector General's report and again this is leaking a lot of

leaking a lot of Lee right so we want to be able to see it as Marie says if we

can as unredacted as possible I'm insubordinate though that's a serious

word that's not like heat that's that's not a little going rogue yeah that's not

a little maybe he felt like he couldn't go directly to the president because his

boss was in the way that connotes that in this report he did

something wrong and insubordinate used for the head of the FBI the irony of all

of this is this goes against the man that he's been trying to portray that he

is James Comey is out in his book door and he's trying to be the example for

these leaders coming up he and that interview with George Stephanopoulos he

said I follow that chain of command I take that very seriously exactly to your

point this goes exactly against the person that he claims to be the people

that I feel for the most in all of this the bigger picture here is the morale at

the FBI occasion I've got about what thirty five thousand employees many of

them are there for the right reasons and they take that job not to be political

but to serve this country and you've got all of these guys at the top pointing

fingers that want to one another I think it's disgusting I think it's really sad

to see this both as a historian and as a novelist let me just suggest and a

former speaker performance week let me just suggest if you have the number two

person at the FBI guilty of something you potentially turning on the number

one person at the FBI who if you read the Rosenstein memo but was was

devastating which trump should have released frankly before he fired it

because it was devastating and really really presage is that what we saw what

we're seeing today because Rosenstein said we can never rebuild the morality

FBI as long as this guy's still there that's that's in the memo by Rosenstein

then you have Comey saying that had the FBI saying of his boss the Attorney

General that she clearly has done things that are terribly wrong and now I

understand you want to suggest that the Obama recession was so sloppily run that

you could have the Attorney General the head of the FBI and the number two

person the FBI all doing these things while at the White House they were

totally ignorant I think that is inconceivable well wait for some

evidence and we'll think well but of course the Justice Department has done

everything it can to avoid the evidence so very quickly seeing that there might

actually be accountability and a story that that many in the media specifically

said was completely closed that there might be accountability is a very good

thing but it also shows this Inspector General so far has been pretty thorough

and maybe we don't need a second special guy I was just thinking the same thing

and in fact because we still have to see the tick-tock and what he found out on

the Hillary Clinton email investigation portion of it which I know we're going

to get to waiting for this IG report and with the delays that we learned about

this week I have had many lawmakers on the hill tell me it'll be worth the wait

because it will answer some questions and and clearly it's answering questions

that we might not have even known we wanted to ask her true well speaking of

investigations a group of Democratic lawmakers now requesting top DOJ and FBI

officials confirm they did not give President Trump or anyone from his legal

team access to the same classified information on the Russia probe that was

briefed to congressional leaders last month

Democrats stating in a letter that the president's attorneys and congressional

Republicans will ultimately attempt to use the information against the agency

adding quote we thus respectfully request that the Department of Justice

confirmed that going forward DOJ and FBI will not brief additional members of

Congress who are not part of the gang of eight on these matters

we should note that House Oversight Chairman trey Gowdy was the only

lawmaker present at those classified DOJ briefings last month who was not a

member of the bipartisan gang of eight so Mr Speaker this is part of this whole

backdrop of the Russian investigation this kerfuffle over who got to go to

what briefings I think the White House landed in a good place to brief the gang

of eight but then the White House sent an attorney for part of the meeting they

got some criticism for that do you think that criticism was warranted because

that's what this letter is addressing in part now no I think they play women just

as well off not to do it but but look look at where we're at we've had a year

and a half of this it's all all sorts of stuff is kept either secret or it's

redacted this is an absurdity I mean you know

that in in Jerry Maguire says show me the money you know of my attitude as an

American citizen is after 17 million dollars and all of these lawyers show me

the evidence yeah and they don't tell don't tell me

there's some magic secret hidden place the whole point of the last election of

the election down the Trump was the American people sending a signal they

are sick of a Washington operating in secret also in Jerry Maguire help me

help you

we help you I mean let me let me do what I can you do what you can right well and

and trey gowdy came out of that meeting and basically said that he is now more

convinced the FBI was proper and how they handled the investigation Paul Ryan

seems to agree with him let's take a look at what he had to say I think

chairman gaudi's initial assessment is accurate

I think but but we have some more digging to do I want to make sure that

we run every lead down and make sure we get final answers of these questions

know this week of course because I'm I was really surprised by gaudí saying

understand but the the issue that the Democrats have is that trey Gowdy

was part of the briefing right it's like what are they really upset about I mean

it just seems like everyone is moving chess pieces just because you know they

feel like they should be playing a game right it's really obnoxious and I agree

with you completely but I also agree for future administration's regardless of

party let's get used to releasing information let's get used to

transparency in this government not just to protect the president or to protect

our chances in the midterms ray but to protect the rule of law and and you know

civil liberties here and those are violated when you have an opaque

government and when you have a gross abuse of power or whether its political

or otherwise we need to see that that thrown open immediately so we stuck

because you know what happens when we abstract and you keep something secret

but you show some others with redactions it just keeps this broken system in

place and you know for for future generations of lawmakers makes it okay

for them to use these great tools for their own means picker where does this

end just quickly we've got a minute here but but you are saying American people

they want this to be done they want to start focusing on the economy things

that impact their daily lives how do you think this ends

oh I think it just gets worse and worse I think we people finally stop and say

explain again why all of Hillary's accomplices were given immunity explain

again why none of this stuff was ever carried out as a legal thing and I think

the more we're learning even today the sicker the system looks so that piece I

was just going to be a worse but it's going to get worse for the establishment

not for Donald Trump I think on the other front if we have very many more

months where we're being told we're gonna have 4.8% real growth and

yesterday's report there now more jobs available than there are people looking

for work I think those kind of things affect the American people they are

become much more but then but the average American talks about that a lot

more than they talk about washing well in the next chapter and that potentially

could be the gap that you see between people looking for work and the jobs

that are out there is that skill base what happens if the skills start to

catch up with those jobs that's going to be like a headwind first of all it's

beautiful for the people looking for jobs I mean but it's a headwind for

Now the once Golden State has drawn battle lines, announcing they are banning travel

to Oklahoma.

Oklahomans are breathing a sigh of relief after waking up to discover that they won't

be receiving LGBTQ-supporting visitors from the state of California anymore…

California on Friday announced a ban on state-funded and state-sponsored travel to Oklahoma in

response to the state's controversial LGBTQ adoption bill, USA Today reported…

The Oklahoma law, passed last month, allows adoption and foster care agencies to reject

same-sex couples on religious grounds.

California's ban, announced by Becerra, came on the first day of LGBTQ Pride Month.

Basically, California is saying they care more about gays than they do the First Amendment.

Nothing in the Constitution grants a gay couple the right to adopt.

Yet liberals put their wishes ahead of people's religious faith.

This should come as no surprise.

Most liberals have zero faith.

They even look down on Christians or anyone with tradition views of God or religion.

Liberals would rather persecute the faithful, in order to help a tiny minority in the country.

But here's the secret: they don't even care about gays.

Liberals make a big deal about LGBT issues, simply to manipulate that community.

They only want the votes.

But when real problems arise—as when 50 gays were killed by a radical Islamic terrorist

in FL—the left does nothing.

Meanwhile a man like Trump can vow to protect gays, and they call him "homophobic."

That's the warped, double-sided politics of liberals.

Something tells me, though, that Oklahoma residents won't be too upset.

I doubt they wanted hardcore leftists visiting, anyway.

troubling days the FBI aren't they they're very troubling days look every

day we learn something new and it doesn't look good and the interesting

thing is we have two investigations two scandals Hillary Clinton email rush

investigation and it's the same cast of characters in both investigations and

one of the things you say in your op-ed is you know we've got director

Christopher ray he's been very clear I'm gonna do everything I can to help

Congress and well he's been but he's playing a double game right he made an

end run around the early on this year when he went to the speaker's office to

try to prevent you know coughing up information chairman noonas had

subpoenaed and I think also at his at a hearing in December II kind of suggested

that he couldn't share this information with Congress because it's classified

it just gets the arrangement backwards you know the FBI in it every federal

agency is accountable ultimately to we the people acting through our elected

representatives one of the other things is you you address we don't know why

things got started right ultimately that's what Congress is trying to get

they want to see the you know the scope memo they want to see the physis stuff

but the FBI and the DOJ say sorry that's off limit and I think that's a big deal

in the sense that this is a story with the cast of thousands Christopher steals

the stephane helper the different FBI Jen's Andy McCabe but we don't know how

it started and the FBI and DOJ has been very resistant in providing the

documents that would let us know how and why this started why is that well you

you have to wonder what the you know whether what would it look

like is that the official started the investigation July 31st was not really

effect yesterday Carter page who was contacted about a conference where he

met Steph and how helped her write and he was contacted about this in May now

you're dead years right and and so I have a lot of affection for the FBI

because I know great men and women that were agents and our agents and so forth

but at the top this leadership I think has just it had been scandalous Chris

Rae could fix it today just like those guys in Congress and say ok I got him

right here you want to really good he could he could he could do this but you

know he gave in his press release that I'm doubling the number of staff that's

an input good question is the output are you giving us access right so far no so

you for having me so you have already survived a brain tumor I mean what

you've already been through in life walk us through the story because of this

doctor who was so determined to find you and let you know he was concerned about

a lump on your neck he might have just saved her life

absolutely I'm so grateful for dr. Waite my mother's friend found the post that

he posted on Facebook and immediately sent it to us we had it checked out

immediately I saw my primary care doctor that exact day and had a biopsy last

week Friday the results came back and I do have papillary thyroid cancer but I'm

just so forever grateful for dr. Hoyt for catching that for being vigilant and

for reaching out to me I mean just to think about the circuit

of the could the how this happened you mean here is an NYU doctor who just

happens to be watching a reality show you don't usually think of elite

physicians and reality shows but heed is watching this and then he's determined

to get ahold of you and he can't find you on Facebook so we just post

something hoping it will find you so when they felt like got ahold of you and

you check this out you must feel like the luckiest person

around yes I feel extremely blessed as you mentioned previously I have already

survived a grade 4 glioblastoma and never anticipated having to be a

two-time cancer survivor especially two cancers in two years but it's just in my

opinion a miracle that he saw it and was able to reach out to me and then I had

it checked out immediately but still Nicole no one wants to find out this

news no one wants to find out they have cancer what does the world look like

ahead for you on Friday I visit a ent Surgery at Duke University for a consult

appointment and I assume that we will set up a surgery in the near future I

have been told by many friends and family and doctor boy especially that

this treatment should be a little easier than my treatment for glioblastoma and

hopefully really just surgery and maybe some maybe some treatment after after

the surgery but but not as extensive physically a blastoma so I'm looking

forward to visiting the doctor on Friday and getting this taken care of and how

do you feel I feel I feel amazing I feel like I've been blessed by this by dr.

voit and what he saw on television I feel like everything happens for a

reason and maybe this was the reason that I was on the HD TV show yeah

absolutely just up quickly a message to people going through this experience but

what's your message this morning my message is that there is always hope I I

want to be an inspiration to folks who are suffering the similar similar

circumstances that don't give up there's always hope

have a positive attitude because I think that makes a world of difference you

going up for governor I think it's a sign that there are a number of people

in California that are wanting some real change well you know we didn't expect

huge victories in the state of California at least for the Republicans

we knew that that wasn't going to happen but seeing a Republican on the ballot

for governor especially with the way that this state runs its primary is

significant for us and it also shows that a trump endorsement

works even in the liberal state of California a trump endorsement means

something I believe it has a lot to do with immigration also taxes regulations

but moving forward we're gonna have to fight but we're ready to do it well one

of the things Tommy is I know Republicans had worried that unless a

Republican finished in the top two it would be two Democrats for that big

state office and then with the other congressional races and stuff like that

what would turn people out thankfully for the Republicans they said last night

we've got a Republican at the top and so people are going to go out and vote and

it's going to be better for us and maybe that blue wave might be actually a

little red well what I hope that lasts yesterday and today and ongoing is going

to show Republicans in this state is that we have to turnout we have to be

vocal we have to make sure that we're voting we succeeded yesterday and making

sure that we have John Cox on the ballot making sure that we can propel him

forward but that doesn't mean that the fight is over we have to continue he has

to make sure that his messaging is very clear to Californians we want to make a

change I think we're going to do it it's going to be a tough

we know in this state gavin newsom is going to be the favorite but we have a

chance for first time in a long time we have a chance well here's the thing in

terms of the house there's about seven Cantera contentious fights there and a

lot of people believe the house will go Democrat or Republican depending on what

happens in California with Darryl ices seat and Dana Rohrabacher seat and so

far the jungle primary has not yielded solid Democrats who were solid

Republicans for that but it got quite close because there's so many Democrats

who felt as though they wanted to run for that seat it diffused a lot of the

votes so it allowed more backer and others to stay up top yeah perhaps they

got a little too excited with their blue wave and it actually ended up helping

out some Republicans but hey there are some things in the state that we can

look at the small victories we're going to take we have a California state

senator who is facing recall because his vote for again a higher gas tax so that

just shows that Californians are upset with the high taxes were upset with

failed immigration policies and no border enforcement we're tired of

over-regulation we're tired of unaffordability so this is a good sign

small victories but we'll take them all right tell me a lot of folks the media

been having a field day about where on earth Melania Trump is and we might have

just hit rock bottom with one reporter from The Rolling Stone Jamil Smith I

mean just read to his tweet he says I wish that I didn't suspect that the

prolonged poorly explained public absence of Melania Trump could be about

concealing abuse I wish that it was a ludicrous prospect I wish that the

president wasn't a man with the history of abusing women including those to whom

he is married no sources nothing to back this up welcome to 2018 by the way

that's not true but go ahead right well we hear journalists we hear the

mainstream media often complain that drunk attacks then that Trump goes after

them that they're losing credibility because of this president no I'm sorry

they're losing credibility because of things like that to advance something so

ridiculous like that and put that out there with no sources no facts just to

speculate on that that's the reason that the American public does not trust the

mainstream media does not trust journalists to put something out there
