I'm Mike Hackard.

I lead the law firm, Hackard Law, in our mission to represent clients in estate, trust and

elder financial abuse litigation.

This mission often leads to mediation, sometimes shortly into the process and sometimes close

to trial.

Whenever mediation occurs it is usually a day-long event – an event that often includes

a "hard day's night."

The process involves a neutral mediator that helps effectuate negotiation between the attorneys

for estates, trusts, heirs, and beneficiaries.

Clients are deeply involved in the process and are understandably swept with emotion

as offers and counter-offers come in.

It is easy to forget the spirit of what the case is really about – a decedent's life

and their wishes to benefit their family, heirs and beneficiaries.

We often start off, much like prizefighters, when the mediator enters the room and says

in so many words "Let's have a clean fight, touch hands, back to your corners" etc.

We may go back to our respective rooms and wait for more instruction.

It is so easy for us as advocates to think of ourselves like prizefighters – aggressively

seeking a win or knockout blow.

So easy – and in many circumstances - so wrong.

Successful mediators know this – they help parties and their attorneys calm down and

move toward a compromise.

There is another aspect of mediation that is long forgotten or given short shrift.

If the decedent could somehow miraculously visit us, we might ask him "What was your

life about?"

Few would say that it was to create rancor and consternation between people that he loved

on earth.

This truth has been brought home to me in a few recent mediations – mediations subject

to confidentiality agreements – so I cannot reference their specifics.

That said, I'll share their spirit- a spirit that strengthened as they went forward.

The mediator comes in.

We are seated with our clients.

Our room is peopled with those who are challenging the estate or trust.

The mediator wants to hear about the decedent – she doesn't want to argue law – she

wants to know the person that this case is about.

One daughter starts –

"He was a great father - a loving father, husband, brother and son.

He ran his own business – was fair to his employees and customers – and set high standards

for himself and others.

His life was one of caring – he wouldn't raise rents on his tenants – he viewed them

as people and not cash flow.

He contributed to our educations and was forever faithful to our mom.

He was lost when she died.

He had Alzheimer's – it was tragic – he forgot our names – and lost his sense of

time and place.

His last days were not like him – he was isolated by his caregiver and somehow convinced

that the caregiver was the only one who cared.

He changed an estate plan that was 30 years in place during the last two months of his

life.

The caregiver got everything.

We didn't even learn that he died until two days later."

She breaks down.

A nephew begins.

"He was at my high school graduation.

He taught me to fish.

We sailed together.

He would drive me by a duplex that he owned and say that he wanted it to be mine after

he died.

I told him that wasn't necessary.

He insisted.

He always remembered my birthday and really helped when my own dad died."

The stories went on – stories of affection, generosity and personal connection.

The mediator was with us an hour.

The mediator visited the caregiver's room.

The decedent helped her and helped her family.

He wanted to change his estate plan because his family "abandoned" him.

He knew what he wanted and he wanted to take care of her.

The story went on.

She is convinced of her position.

The mediator returns.

This time the lawyers talk more.

We have medical records and we have a neurologist's report.

The decedent had Alzheimer's disease – a disease in this case easily documented.

At the time he amended his trust, he couldn't drive, he could barely see and he didn't

really remember who his relatives were.

In essence, the scourge of Alzheimer's, grief, loneliness and diminished cognition

had done its sad work.

The mediator and the lawyers now know him – the decedent – a man that they'd never

met.

A man who for the lawyers when they began their tasks was just a financial vehicle.

He was bloodless.

We now knew he was more.

He was caring, and if we were really to serve him, we needed to act as human beings – not

just as lawyers.

The mediation went on.

Somehow the other side got humanized – yes, we felt there was wrongdoing – and the other

side felt deserving.

How could the gap be bridged?

Moving on hours later – the gap was bridged – all chose peace and resolution over uncertainty

and continued institutionalized rancor prescribed by the rules of court and demands of litigation.

We left that night with an agreement and even more than that a sense that a man who had

been generous in life was not forgotten in the tumult of a financial tug of war.

significant difference and there is a party who can be made accountable for financial

wrongdoing.

 This usually involves a surge of administrative work to be completed by club officials

 If all information is handed to the FA by the end of the extension, the deal will be completed

 This was the case when Adrien Silva's move from Sporting CP to Leicester missed the extended deadline by 14 seconds in 2017

When does the January transfer window close for English and Scottish teams? Teams playing in the English leagues have until 11pm tonight to complete their transfer dealings

 Clubs will be able to apply for a short extension if they submit all relevant paperwork before the 11pm deadline

 Loan deals must be completed in the same timeframe as permanent transfers though free agents can be acquired outside of the window

 All professional clubs in England and Scotland must adhere to the same rules to ensure a level playing field

The first was for coaching, the second (a point penalty) for racket abuse and the third (game penalty), in which Williams was already down a set and 4-3 in the second, for verbal abuse

 In the heat of the moment, Williams had strong words for chair umpire Carlos Ramos: "There are men out here who do a lot worse than me, but because I'm a woman, you are going to take this away from me? That is not right

" The fallout was controversial, to say the least. But the incident led us to wonder: Was there a trend in either direction for men's and women's players? The USTA, in response to our findings, said in a statement, "One could argue that not all rules, especially as it relates to coaching, were applied consistently throughout the tournament

" We watched 73 matches from the 2018 Grand Slam season in their entirety -- 100 sets of men's tennis and 100 sets of women's tennis

We tracked the number of times the rules were broken, as well as the number of times players were penalized for those infractions

 We could only see what the cameras captured, so we likely weren't able to catch every infraction; but the sample size gave us a strong indication of the rate of penalization for men and women

 In trying to determine which rules were broken, we referred to the Grand Slam Code of Conduct

We subjectively rated infractions on a scale of 1 to 5, with 1 being a less-egregious interpretation of the rules and 5 being an indisputable violation of code

 "The US Open utilizes the best officials in the world, yet we do believe we need to ensure consistent rule applications to all players and all circumstances," said Chris Widmaier, the USTA's managing director of corporate communications

"As you noted in your study the 'numbers don't suggest an inequity between treatment of men's and women's players,' [yet] Serena Williams was not given much leeway

"CoachingBased on the numbers we uncovered, Serena Williams had reason to be upset by the coaching violation handed to her at last year's US Open

 ESPN Illustration The Grand Slam Code of Conduct states, "Players shall not receive coaching during a match (including the warm-up)

Communications of any kind, audible or visible, between a player and coach may be construed as coaching

" During the US Open final, Ramos issued Williams a code violation and warning for receiving coaching from her coach, Patrick Mouratoglou, when he signaled to her to approach the net

That incident started a cascade of events, with Ramos ultimately penalizing Williams a point and a full game for additional code violations

 While coaching is against the rules, we found that the question of whether Williams and Mouratoglou were justified in their anger for the coaching warning had some merit

 In the 200 sets of tennis we analyzed, Williams was the only player to receive an official penalty, which is more eye-opening when you consider how much more coaching we saw in the men's matches we watched

 Williams, on Tuesday at the Australian Open, did not comment when asked about the state of coaching in today's game

 Of the eight coaching warnings and three verbal abuse warnings given in the 100 sets of women's tennis we watched, she was the only player penalized, and the infractions couldn't have come at a more crucial time

Carlos Ramos and Serena Williams In our analysis, five of Ramos' matches were examined

Putting aside the US Open women's final, which might be seen as an outlier event, Ramos issued only one other penalty in the matches examined

That penalty was a time violation warning against Nikoloz Basilashvili in his fourth-round US Open match against Rafael Nadal

 A look at the data from the other four Ramos matches (Serena Williams was not part of these matches): Sets umpired: 13

 Penalties issued: 1. Rate of penalization per set: 7 percent. As for Williams, here are her numbers from the other six matches we watched from 2018: Sets: 15

 Penalties issued: 0. "Again, we need to do our best for consistent application of the rules," Widmaier said

 'I feel so excited for them and my plan is just to make sure that they're feeling happy and confident and comfortable with what they've got to do

'  And Cheryl is unable to choose which show she prefers between her old show The X Factor and current show Greatest Dancer

On the series, Cheryl sits alongside Matthew Morrison and Oti Mabuse, who act as a trio of captains, taking on acts and coaching them through to the final

 The prize is a chance to dance on Strictly Come Dancing 2019, as well as a sizeable cheque

 Cheryl also shared photos where she posed proudly alongside her final Greatest Dancer acts Harry and Eleiyah, dance collective Dane Bates and male group Frobacks

She wrote: 'My final three acts. So excited to get to showcase what we've been working on for the live shows next week

 'Thank you so much for showing them your support.' Cheryl and her fellow The Greatest Dancer captains, Oti and Matthew were relieved as they finally picked their final nine contestants

But viewers were left disappointed as favourites Andrew and Chris failed to get through to the next stage of the BBC competition

Taking to Twitter in their droves, fans claimed they were 'totally gutted' as Andrew, who has Down's Syndrome, or Chris, who is deaf, were booted off the show, after wowing the judges with their initial auditions

Former Girls Aloud singer Cheryl was brought to tears when Andrew first took to the stage with a passionate performance earlier on in the series

Overwhelmed with emotion, the Fight For This Love hitmaker told the contestant: 'I just feel really moved by the whole thing, that was amazing

'Meanwhile, Chris lit up the show with his dance routine and received a standing ovation from Cheryl, Strictly's Oti, 28, and Glee star Matthew, 40

  Taking to Twitter in droves, fans raged as the captains failed to put the pair through to the next round

One angered fan wrote: 'Ok, think my #thegreatestdancer journey just ended, I can't believe that Chris didn't get through

To be able to dance like that while not hearing the music is beyond talent.  Sad for Andrew too, what he lacked in technicality he made up for in enthusiasm

A third tweeted: 'Gutted Andrew didn't make the final of #thegreatestdancer. I'm biased as my Nephew has Downs but either he or Chris would have been great representation for people with disabilities

 The first move on deadline day was done just after 10am when Wolves completed the permanent signing of Jonny Otto from Atletico Madrid for what is understood to be a club-record £18million fee

 Jonny, who has made 22 appearances on loan in the first half of the season, has agreed a permanent deal at Molineux until 2023

 "I'm very happy to sign for Wolves," the 24-year-old told the official club website

 "The last few days we spoke about it and now it's official, I'll be Wolves for the next four years

 "I'm really happy to continue to be involved with the team. I am very happy here, the truth is that it was very easy to decide

What Ed Woodward said about Fellaini a month after he signed midfielder - Duration: 1:54.

  It appears as though Marouane Fellaini 's time at Manchester United is up.  Despite signing a new deal at the club last summer, the Belgium midfielder looks set to leave the Red Devils and join a Chinese Super League club

 Shandong Luneng have offered the 31-year-old a contract worth £200,000-a-week, which, if he accepts, will bring an end to his five-and-a-half year spell at United

  The midfielder was brought in under David Moyes, shortly after Sir Alex Ferguson had retired as Red Devils boss

  Ed Woodward oversaw the signing in what was his first transfer window at the club

 The transfer didn't enthrall fans as many didn't see the 6ft 4in midfielder as a traditional United player

Something Solskjaer clearly agrees with.  Since the Norwegian took charge last month, Fellaini has only played 31 minutes of game time

 And with an offer on the table from a Chinese Super League club it appears United fans have seen the last of Fellaini

  So why did United sign Fellaini in the first place? According to ESPN's Andy Mitten , Ed Woodward told him exactly why a month after the signing

 "Fellaini is the first central midfielder we've bought in six years," the executive vice-chairman informed him

 The last two midfielders to arrive at the club before the Belgian were Anderson and Owen Hargreaves in 2007, the same season United won the Champions League
