California heirs and beneficiaries expect that trustees, estate representatives and

executors will act as good and prudent fiduciaries.

When these fiduciaries fail and take money belonging to trust beneficiaries, they may

be subject to civil and even criminal penalties.

There are several cases in point.

A Sacramento woman was indicted by a federal grand jury in April 2018 for mail fraud, wire

fraud and money laundering (U.S. v. Stewart-Cabrera, United States District Court, E.D.

California, Case No. 2:18-CR-0085 KJM).

The woman, a professional fiduciary, served as the trustee of a trust that owned Sacramento

property.

The U.S. Attorney's news release indicates that Loretta Darlene Stewart-Cabrera, the

trustee, carried out a scheme in which she sold property for $300,000, gave the trust

beneficiaries $30,000 and spent the rest.

She used some of the trust proceeds for a Las Vegas gambling trip.

Her case is still ongoing.

A San Diego probate trustee, Teresa Laggner, was sentenced to 18 months in prison for draining

hundreds of thousands of dollars from client trust accounts.

The money was used by her for gambling at local casinos – a habit that resulted in

more than $1 million in losses over a four-year period.

At one time Ms. Laggner was overseeing over $20 million in assets.

While a trustee's wrongdoing by be suspected, it may take a fair amount of litigation discovery

and forensic analysis to gather supporting evidence.

Most victims are in disbelief, questioning why and how a trustee would commit such wrongdoing

– wrongdoing that may also be a crime.

It seems to be the classic "breaking bad" – to "defy authority" and break the

law.

How Youth in California Light the World Each Christmas - Duration: 3:07.

We wanted to teach young people, but we wanted it to have more of a purpose.

I wanted it to be something where, yes they develop their talents, but I wanted to

develop the goodness in them. Because for me, I would rather have them be good people

than just good performers.

I'm Jeri, and I'm Richard Clinger. And we've been doing Galena Street East

now, we're in our 47th year. Just after we got married, we moved to Los

Angeles to do show business professionally. We saw some of the

sacrifices that, particularly the youth were making, to be in the business.

Basically our holiday tapestry that we've been doing for 47 years now is

about, the first half of the show is mainly international festivals,

honoring people's culture, heritage, tradition. And then the second half of

the show is more about the real meaning of Christmas.

I wanted to join Galena

when I was in, like, fifth grade. I went to the first Christmas show that I had ever

seen, and I was just, like, so tuned in to the entire show.

Christmas can also be a hard time, because if you've lost a loved one or

you're going through your own personal struggles, to come to something—a

Christmas show—is not something they really want to do, and yet they'll go

away feeling, "I can face the season. I can face this holiday season." And for our

youth that are having problems, for a few minutes they can forget that too.

When you're growing up, you're a teenager, you are going through hardships. I had a lot of

difficult times going on in my family. And I feel like all kids struggle. All

teenagers struggle, but I was really just kind of overwhelmed, felt like I couldn't

do it anymore and, like, move on, I guess. I really was struggling with depression,

anxiety, but being able to perform even though I was struggling and making

people smile that are also struggling and serve them with something that I worked

really hard at is definitely something that helps me understand my worth more

and just realize we're here to make each other better and make impacts on

people's lives wherever we can.

I think the Lord is concerned with every aspect

of our lives, and especially in reaching the youth.

Every time we think, "Is this the year maybe we should stop Galena?" We take it to

the Lord, and we go to the temple, and we pray about it. And we feel that the

Lord still has, there's still a youth out there that needs our help.

Looking back, I can still, like, see people smiling in the crowd. And just being able to

provide that for someone who might have also been

struggling, I feel like was really important for me.

California lawmaker arrested on child cruelty suspicion - Duration: 4:46.

California state lawmaker Joaquin Arambula was arrested Monday on suspicion of misdemeanor child cruelty, Fresno police Chief Jerry Dyer said

The arrest came after officials at Dailey Elementary Charter School discovered an injury on a child who came into an office Monday afternoon, Dyer said

He did not describe the injury or Arambula's relationship to the child. He was cited for willful cruelty to a child, Arambula, a Democratic state assemblyman, is married with three young daughters

"Joaquin is a committed father who wants what is best for his children," his spokeswoman Felicia Matlosz said in a Tuesday statement

"He is fully supportive of the process, which will show he is a loving and nurturing father

" Arambula is a former emergency room physician who won a 2016 special election to represent part of Fresno and the surrounding rural areas

His father Juan Arambula was a state assemblyman in the early 2000s. Officials at the elementary school reported the child's injury to child protective services, which called Fresno police, Dyer said

Officers called Arambula and his wife, Elizabeth, who both arrived at the scene. The child described how the injury occurred and said Arambula inflicted it, Dyer said

The police determined the injury happened Sunday evening. Arambula was cooperative and cordial, but he did not provide a statement to officers based on advice from his attorney, Dyer said

Officers were "confident that a crime had occurred" and arrested Arambula on suspicion of willful cruelty to a child, Dyer said

He was taken in a patrol car to police headquarter, finger-printed, photographed and then released because his crime is a misdemeanor

The injury did not rise to the level of a felony. All school district employees in California are considered "mandated reporters" under state law, meaning they are required to report known or suspected child abuse

They are not responsible for determining if an allegation is valid, according to the state Department of Education's website

They are expected to report if abuse or neglect is suspected or a child shares information leading them to believe it took place

They are then required to call law enforcement or child protective services, and law enforcement is required to investigate

A physical injury inflicted on a child by someone else intentionally is considered child abuse or neglect

Officials at the elementary school and Fresno Unified School District did not immediately respond to requests for comment

Northern California is figuring out how to tackle an unusual form of vandalism after 60 electric scooters were pulled from a one lake during October

Oakland's trendy form of transportation, designed to reduce pollution from cars, seems to have taken a dive as Lake Merritt has become a dumping ground for e-scooters

Vehicles mainly owned by Bird and Lime that people hire to get around the city using a booking app, have been dragged out of the water in their dozens

4 miles of shoreline of the oldest wildlife refuge in the state. The batteries contained within the scooters – some of which also belong to Skip and Wind - pose a risk to marine life

Ironically, the scooters were intended to help save the planet, with Bird claiming that when New York City's L train closes down next year, introducing their system could replace the 1,500 more cars expected to be on the road, saving planet Earth 7

25 metric tons of carbon emissions.'We've been having a fair amount of the e-scooters come into the lake or thrown into the lake rather,' said James Robinson, Executive Director of Lake Merritt Institute said

 'These can be very damaging to our marine environment because they're not natural things that go into the lake

'While numbers for November have not yet been reported, it's believed the random e-scooter dumping shows no sign of slowing down

Although scooters are sometimes left in a place they not supposed to be parked, Robinson, whose company is responsible for maintenance of the lake, found the act of vandalism bizarre

'Additionally, each Lime scooter is equipped with GPS, which shows our operations team when a scooter is inside the lake,' Lime said in the statement

We immediately deploy our operations teams to collect the scooters when we receive an internal or external report that a scooter is in the lake

'Anyone found to be responsible for abandoning the e-scooters will be banned from the app

Witnesses with information are asked to call the non-emergency number of 311 or report incidents online

It not the first big pollution problem of its kind on the west coast. Similar incidents were reported in San Francisco and Los Angeles

Portland, Oregon's Willamette River has had 17 dumped according to ScooterInTheRiverPDX

com and the Spokane River in Washington recovered two Lime scooters in October.Elsewhere in the United States e-scooters have been submerged in Trinity River in Dallas, Texas and the Broad Ripple Canal in Indianapolis
