It comes less than a week after North Korea launched its newly developed inter-continental

ballistic missile.

The five-day exercise is the largest ever combined air force drill between the two allies,...

involving 230 warplanes and around twelve-thousand personnel.

(Korean) "The exercise is held annually.

We hold it to enhance our joint operations capabilities."

Six F-22s and six F-35s have been deployed to the Korean peninsula,... marking the first

time the highly-advanced jets have cruised the skies above Korea at the same time.

Other U.S. assets include two B-1B bombers and six Growler electronic warfare jets as

well as dozens of F-15s and F-16s.

South Korea has deployed 90 fighter jets, including its F-15 and FA-50 fighters.

North Korea condemned the drills on Sunday saying they could lead to an all-out provocation

that may lead to a nuclear war.

Running a commentary in North Korea's state-run Rodong Sinmun on Sunday,... Pyongyang said

"such a drill is a dangerous provocation as it's driving tension on the Korean peninsula

to the brink of a war",... and that both "South Korean and the U.S. puppet forces are foolish

to run amok with such stealth fighters."

U.S. Senator Lindsey Graham issued a stunning statement on the North Korean crisis Sunday,

indicating that America could be closer to war than most people realize.

Graham appeared on CBS� �Face the Nation� on Sunday morning, and made a surprising admission:

the United States military should move families of military members out of South Korea, fearing

their safety is in immediate danger from North Korean aggression.

�It�s crazy to send spouses and children to South Korea,� Graham told host John Dickerson.

Graham�s concerns signal that, as a member of the Armed Services Committee, America may

be much closer to conflict than most are willing to admit.

Graham also said the United States should consider a preemptive strike, and not wait

for North Korea to become fully nuclear-capable.

Republican U.S. Senator Lindsey Graham on Sunday urged the Pentagon to start moving

U.S. military dependents, such as spouses and children, out of South Korea, saying conflict

with North Korea is getting close.�It�s crazy to send spouses and children to South

Korea given the provocation of North Korea,� Graham, a member of the Senate Armed Services

Committee, said on CBS�s �Face the Nation.�

�So I want them (the Pentagon) to stop sending dependents and I think it�s now time to

start moving American dependents out of South Korea,� Graham said.

The United States has 28,500 troops in South Korea as a legacy of the 1950-53 Korean War.

On Wednesday, North Korea tested a new type of intercontinental ballistic missile (ICBM)

that can fly over 13,000 km (8,080 miles), placing Washington within target range, South

Korea said on Friday.

Graham said this development showed conflict is approaching.

�We�re getting close to military conflict because North Korea is marching toward marrying

up the technology of an ICBM with a nuclear weapon on top that can not only get to America,

but deliver the weapon.

We�re running out of time,� Graham told CBS.The Pentagon referred questions to the

Pacific command, which was not immediately available for comment.

North Korea has many faces.

While making a choice that displayswillingness to further isolate itself, the regime showed

signs of wanting to talk, one such attempt reportedly made even after carrying out the

provocation.

The hermit kingdom reached out to Russian lawmakers and an American expert close to

the Trump administration... not once, but several times this year.

North Korea reportedly attempted to meet a U.S. expert close to the Trump administration

several times this year.

In an interview with Tokyo-based Sankei Shimbun,... Douglas Paal, Vice President for Studies at

the Carnegie Endowment for International Peace, said...

Pyongyang proposed meeting EIGHT TIMES this year,... the most recent being in early October.

The regime apparently suggested...that Paal could visit North Korea and meet with high-level

officials there,... or speak to Choe Son-hui , director-general for North American Affairs,

in a third country like Switzerland.

Paal said he rejected all the proposals.

A North Korea expert says...

Pyongyang has its eyes on the negotiation table... but on the condition it's recognized

as a nuclear state.

(Korean) "The Kim Jong-un regime's ultimate goal is

to first become recognized as a nuclear state... and then negotiate with the U.S. to recover

bilateral relations, sign a peace treaty, and has its security guaranteed.

There's no reason for Kim to refuse talks; in fact, he wants them.

So, seems like he is trying to figure out what the Trump administration's stance is."

North Korea's intention to hold talks was evident in a message it sent to a few Russian

lawmakers who visited the regime last week.

Meeting with the Russian delegation the day after Hwasong-15 ICBM launch,... a high-level

North Korean official said,... the North is ready to start negotiations with the U.S.,...

but ONLY IF Washington recognizes Pyongyang as a nuclear state.

The U.S. shunned that claim.

The U.S. State Department spokesperson for East Asia Affairs told Voice of America,...

that Pyongyang should first be ready to (quote)"cease and rollback" its nuclear weapons program.

She added... that the U.S. does not see any signs... that Pyongyang is willing to have

credible talks on denuclearization... and that it's not enough for the regime to stop

its program where it is today.

Marinello v. United States [SCOTUSbrief] - Duration: 4:00.

Carlo Marinello is the petitioner in this case.

He was convicted by the DOJ of tax fraud as well as obstruction.

He owned and operated his own freight couriering business.

He did not keep a tight ship.

He was accused of impeding the administration of the tax code by failing to maintain corporate

books and records, failing to provide his accountant with complete and accurate information

related to his personal income and the income of his business, destroying and discarding

business records.

The government, in this case, claims that Mr. Marinello committed north tax fraud and

obstruction.

The IRS has defined obstruction as any attempt to interfere with the day-to-day work of the

IRS.

Mr. Marinello admits that he committed tax fraud.

But he says that he can't also be convicted of obstruction when he did not even know that

an investigation was underway.

The fighting issue in this case really is: Can a defendant be said to have a criminal

state of mind to obstruct when he doesn't know that an investigation is in process.

More typically in criminal cases, obstruction is related to after-the-fact behavior.

Section 7212(a) of the Internal Revenue Code says, "Whoever corruptly, or by force, endeavors

to obstruct or impede the due administration of this title shall, upon conviction therefore,

be fined not more than $5,000 or imprisoned not more than three years, or both."

The term corruptly goes to a defendant's state of mind, and state of mind is a very important

question in every criminal case.

State of mind, or scienter, as the law defines it, is an element of almost every criminal

offense.

A person cannot be guilty of a crime unless he intended to cross a certain line.

So whether or not Mr. Marinello possessed the requisite state of mind is a critical

question in this case.

As it's written, it's very broad.

The IRS gets to decide whether or not their procedures have been interfered with.

A broad interpretation of the statute gives the IRS more power to pursue more wrongdoers.

The government's position, in this case, is that every hour of every day, the United States

IRS is administering the tax code.

The IRS basically says that Mr. Marinello, as a business owner, should have known that

is conduct violated tax law.

Mr. Marinello says that although he may have ad- violated the tax law, he did not know

that he was obstructing in any way a pending investigation.

Statutes have to be clear enough that a reasonable man would know he was violating them.

The government's best argument is its reliance on the plain language of the statute.

The statute in question nowhere mentions a pending investigation, nowhere requires the

defendant have knowledge of a pending investigation.

And the government says, by its own terms, the statute does not require this additional element.

The government argues that Mr. Mar- Marinello has simply made this up to suit his own situation.

A victory for the government is the ability to send a strong message to taxpayers that

they will be pursued aggressively for any perceived violation of the tax laws.

And this case would certainly embolden the IRS to continue to seek aggressive judgments

and prosecutions against defendants whether or not they knew an investigation was underway.

North Korea's state media is continuing to praise its latest ICBM test,... calling it

a "historic completion" of its nuclear weapons program... and proof of its mastery in missile

technology.

A large rally was held in Pyongyang... and celebratory remarks delivered by top regime

officials... to commemorate this self-proclaimed milestone.

Analysts say this is a political move... aimed at pressuring the U.S. to recognize the North

as a nuclear power... for use an important bargaining chip before a possible return to

dialogue.

The reclusive nation may be willing to return to the negotiating table with Washington...

as parties of equal standing... in order to guarantee the regime's continued survival.

In fact,... following North Korea's initial claim back in 2005... that it successfully

developed nuclear weapons,... one of the regime's stated goals called for the improvement in

its relations with United States.

Also in 2007,... just a year following its first nuclear test,... it also enjoyed major

success on the diplomatic front... including an inter-Korean summit among other cross-border

agreements.

However, Pyongyang's true intentions aside,...

U.S. officials now say that last week's test-fired missile,... may have broke up as it re-entered

the Earth's atmosphere.

Although technical analysis is ongoing,... the officials say North Korea is struggling

to master the necessary re-entry technology,... to obtain a fully-working ICBM.

It remains to be seen if Pyongyang's latest escalation could,... ironic as it may sound,...

provide the impetus for renewed talks between North Korea and the U.S.

As the world remains on the brink of war with North Korea, 12,000 U.S. troops were just

deployed to the Korean Peninsula.

Hundreds of aircraft and thousands of soldiers converged in the region for a joint drill

with South Korea in preparation for a full-scale war with the North.

According to the Daily Star, the drill is the largest ever of its kind, and it comes

as tensions between President Trump and Kim Jung Un reach fever pitch following Un�s

most recent rocket launch.

Vigilant Ace � a massive joint war games � kicks off today as the US and South Korea

rehearse for battle with Pyongyang.

Hundreds of aircraft and thousands of soldiers and airmen are taking part in the drill, which

is one of the biggest ever of its kind.

US and South Korean forces will be rehearsing for a full-scale war with North Korea.

Nuclear fears have reignited as Kim fired his latest missile last week � his biggest

and most powerful yet, the Hwasong-15.

And there now fears Kim could be readying the dreaded Juche Bird, his most shocking

weapons test to date.

US President Donald Trump will be looking to flex his muscles as he dispatches his most

deadly fighter planes to ready for war in Vigilant Ace.

�Vigilant Ace 18 highlights the longstanding military partnership, commitment and enduring

friendship between two nations,� the US military said.

Included in the drill will be 12,000 U.S troops along with 230 American warplanes, of which

there will be dozens of F-22 Raptors and F-35 Lightning Bolts, two of the military�s most

feared fighter jets, both capable of reaching speeds of well over 1,000 mph and carrying

devastating payloads.

The American forces will be joined by at least 4,000 South Korean troops, and the joint exercise

will last from now until Dec. 8.

The news comes as South Korea is preparing a special warfare team to take out Jung Un

if the two countries end up at war again.

Should war break out on the peninsula, an elite South Korean special operations force

may be dispatched to take out Kim Jong Un, according to South Korean media.

South Korea�s Special Warfare Command established a �decapitation unit� Friday to eliminate

the North Korean leadership, should a conflict again arise.

The new unit is modeled after the U.S. Army Rangers, Delta Force, SEAL Team Six and the

Green Berets, according to the Korea JoongAng Daily.

Meanwhile, President Trump has repeatedly warned �Lil Kim not to test America�s

resolve under his leadership, and that if he does, we�ll bring �fire and fury�

upon his country the likes of which haven�t ever been seen in the world.

Hopefully, a diplomatic solution is able to be found with North Korea.

However, should the need arise to take military action, we should be grateful we have a leader

willing to do what�s necessary to win.

It has been a longstanding tradition that the former and current president of the United

States work together for their love of country.

Both men would put aside their differences and political ideology to focus on what is

good for the American people and our future.

However, that is not the case when it comes to Barack Obama and his lack of respect for

our country and President Trump, but is anyone honestly shocked?

This past year, Obama was finally reduced back to just being an average citizen of the

country, and no longer the most powerful man on the planet which apparently has not settled

well with the egotistical Obama.

So, every chance that Obama gets he takes a jab at the president and virtually undermining

his role in leading the country efficiently.

Not only has Obama been vocal about his displeasure with President Trump in the White House, but

he has also set up residence just a few miles away from the White House to continue monitoring

Trumps' movements.

Now, it appears that Obama really stepped over the line after being caught red-handed

attempting to destroy President Trump which happens to be a federal crime.

Over the past year, Obama has been doing all that he can to undermine President Trump's

administration, whether it was when Obama followed Trump overseas during his first trip

as president or the G20 Summit meeting in Germany Obama has always been close behind.

Now, all of those are horrible offenses, but none could honestly be as bad as what Obama

was just caught doing overseas over the past week.

Obama has been on a world tour again, stopping off and speaking to world leaders in some

pathetic attempt to relive his "glory" years.

Though instead of the failed "president" just stopping by, picking up some souvenirs

and going on his way, Obama has been busy mocking President Trump on a world stage.

Barack Obama was first seen with President Xi Jinping of China after President Trump

just had a successful visit a few short weeks ago.

Obama opened his trip Tuesday in Shanghai, where he delivered a speech at an event hosted

by business non-profit the Global Alliance of SMEs, which was attended by some 2,500

industry executives, according to the organization's website.

He stressed in his speech that China-U.S. relations were the most consequential bilateral

ties in the world, and dialogue was the only way to solve disagreements, according to the

Shanghai-based news website the Paper.

As part of the three-nation tour, he'll also meet with Indian Prime Minister Narendra

Modi.

Obama's office said in a news release Tuesday that the former president had "forged a

close and cooperative partnership with President Xi on issues ranging from growing the global

economy to combating climate change, and he looks forward to catching up with his former

counterpart."

Ok, here is where the issue lies with Obama chatting with President Xi.

Obama is no longer a representative of America and holds no current position with the current

administration so, in all reality, he has no business discussing anything with President

Xi, but more importantly, it is against the law.

Obama is inserting himself into world affairs that he is no longer apart of and could cause

further issues which is why he needs to stop and fast.

However, that is not the Obama way, and we found him traveling world inserting himself

into more American affairs without proper clearance.

Obama then traveled to India and France slamming President Trump and peddling global warming

that has hardly proven to be true.

While Obama was in India, he mocked President Trump saying that he has more Twitter fans

than the president."And look, I've got 100 million Twitter followers.

I actually have more than other people who use it more often," said Obama, followed

by, "Think before you tweet."

Then, Obama went on to slam President Trump again undermining his policies and saying,

"We have a temporary absence of American leadership' on climate change.

"I grant you that at the moment we have a temporary absence of American leadership

on the issue," the former president noted, which was met with laughter from the room

Again, this is a private citizen speaking poorly about policy overseas which in fact,

Now, you be asking yourself, what is the Logan Act, and how does this apply to Obama and

his worldwide bash Trump tour?

The Logan Act was implemented in 1799 to prevent citizens from like Obama from talking against

the policy of the U.S. government.

As of yet, no one has been charged in our nation's history with a violation against

the Logan Act, but Obama is so intent on leaving a legacy, this could be right up his alley.

It is disgusting that Obama is traveling the world bashing Trump without any repercussions,

but that is what happens when the U.S. government is riddle with swamp creatures.

For any of this to stop President Trump will have to take a tougher stance against those

that seek to destroy the country and his presidency by making an example of one of them.

And, Obama may be the best candidate for to make history.

Now, the United State Senate has issued a terrifying order that shows how close we are

to war and it may happen sooner than later.

North Korea, as you know is a communist country and their only desire is to have world domination

by any means possible.

The lunatic leader, Kim Jong-Un and all that came before him have treated their people

in the worse possible, killing them for no reason and they live in squalor.

Kim Jong-Un and those in North Korea are so full of hate that they wish to destroy the

United States and Western culture since it stands for everything they do not have.

Over the past several months, the threats from Kim Jong-Un have been increasing as well

as their missile launches that are only becoming more frequent.

In light of the ever-growing tensions, United States leaders are now stating that war is

imminent and that American military families should get out of South Korea before it is

too late.

And, with approximately 28,500 U.S. troops stationed in the area, plus thousands of more

family members that is a warning that is not given lightly.

Sen. Lindsey Graham said Sunday that he believes it�s time to start moving the families of

American military personnel out of South Korea as North Korea pushes the U.S. closer to a

military conflict.

Graham, a member of the Senate Armed Services Committee, said he will also urge the Pentagon

not to send any more dependents to South Korea.It�s crazy to send spouses and children to South

Korea, given the provocation of North Korea.

South Korea should be an unaccompanied tour,� the South Carolina Republican said on CBS�

�Face the Nation.� �So, I want them to stop sending dependents, and I think it�s

now time to start moving American dependents out of South Korea.�

About 28,500 U.S. troops are stationed in South Korea to deter potential aggression

from the North.

Last week, North Korea shattered 2� months of relative quiet by firing off an intercontinental

ballistic missile that some observers say showed the reclusive country�s ability to

strike the U.S. East Coast.

It was North Korea�s most powerful weapons test yet.

The launch was a message of defiance to President Donald Trump�s administration, which a week

earlier had restored North Korea to a U.S. list of terror sponsors.

It also hurt nascent diplomatic efforts and raised fears of a pre-emptive U.S. strike.

Threats traded by Trump and North Korean leader Kim Jong Un have further stoked fears of war.

Graham expressed confidence in the Trump administration�s ability to manage the growing conflict with

North Korea.

�He�s got the best national security team of anybody I have seen since I have been in

Washington,� said Graham, who has served in Congress since 1995.

The Trump administration has vowed to deny North Korea the capability of striking the

U.S. homeland with a nuclear-tipped missile.

�Denial means pre-emptive war as a last resort.

The pre-emption is becoming more likely as their technology matures,� Graham told CBS.

�I think we�re really running out of time.

The Chinese are trying, but ineffectively.

If there�s an underground nuclear test, then you need to get ready for a very serious

response by the United States.�

Trump has said he spoke with Chinese President Xi Jinping about Pyongyang�s �provocative

actions,� and he vowed that additional major sanctions will be imposed on North Korea.

China is North Korea�s only significant ally, but it has grown increasingly frustrated

over the North�s nuclear and missile tests that have brought a threat of war and chaos

to China�s northeastern border.

The left has created this monster by appeasing Kim Jong-Un and others like him around the

world so much so that Jong-Un thinks he can get away with this insane behavior.

Now, while in the past these sorts of actions would have caused Obama to go in and give

Jong-Un what he wanted all in the name of �diplomacy�, but thankfully, those days

are over.

If Kim Jong-Un wants war then we will be ready.

The time of bending over and allowing terrorists to call the shots is over and with President

Trump at the helm, you can be sure our country will be the victor.

U.S. Senator Lindsey Graham issued a stunning statement on the North Korean crisis Sunday,

indicating that America could be closer to war than most people realize.

Graham appeared on CBS� �Face the Nation� on Sunday morning, and made a surprising admission:

the United States military should move families of military members out of South Korea, fearing

their safety is in immediate danger from North Korean aggression.

�It�s crazy to send spouses and children to South Korea,� Graham told host John Dickerson.

Graham�s concerns signal that, as a member of the Armed Services Committee, America may

be much closer to conflict than most are willing to admit.

Graham also said the United States should consider a preemptive strike, and not wait

for North Korea to become fully nuclear-capable.

Korea said on Friday.

Graham said this development showed conflict is approaching.

�We�re getting close to military conflict because North Korea is marching toward marrying

up the technology of an ICBM with a nuclear weapon on top that can not only get to America,

but deliver the weapon.

We�re running out of time,� Graham told CBS.The Pentagon referred questions to the

Pacific command, which was not immediately available for comment.

A massive South Korea-U.S. military exercise will take place over the Korean Peninsula

starting today,... the largest joint drill the allies have ever held.

Designed to boost "combat effectiveness" against North Korea,... the United States has sent

some 230 combat aircraft,... including the most sophisticated stealth fighters and bombers.

The air forces of South Korea and the United States are ready for another joint exercise,

set to start on Monday.

The 5-day drill, dubbed Vigilant Ace, will involve more than 230 warplanes from both

sides, including 6 U.S. F-22 Raptors, and 6 F-35s -- some of the air forces' most advanced

fighter jets.

Throughout the training about 12,000 personnel will demonstrate wartime defenses and airstrikes

on mock North Korean nuclear and missile targets.

The exercises come after the North fired an intercontinental ballistic missile last Wednesday.

Pyongyang condemned the scheduled annual drill.

Its state media said Washington is "begging for nuclear war," and claimed that the missile

launch was a legitimate part of strengthening what it called its "self-defensive nuclear

deterrence."

North Korea's latest missile is believed by experts to be capable of reaching all parts

of the continental U.S.

Despite its range, though, reports say U.S. officials now believe the missile likely did

not survive re-entry into the Earth's atmosphere.

Amid growing tensions, Washington's National Security Advisor H.R. McMaster says the North's

nuclear program is the "greatest immediate threat" to the United States -- that the risk

of war with North Korea is growing every day, and that Washington is in a race to find a

solution.

are blazing across the skies surrounding the Korean peninsula.

Their goal in this training exercise is to take out key North Korean nuclear facilities.

Scores of fighter jets neutralize hostile threats,... while escorting bombers to their

designated targets north of the border.

The bombers drop their bombs,... demolishing all targets.

The simulation of a possible war-time scenario is part of the major air force exercise dubbed

Vigilant Ace.

It comes less than a week after North Korea launched its newly developed inter-continental

ballistic missile.

The five-day exercise is the largest ever combined air force drill between the two allies,...

involving 230 warplanes and around twelve-thousand personnel.

(Korean) "The exercise is held annually.

We hold it to enhance our joint operations capabilities."

Six F-22s and six F-35s have been deployed to the Korean peninsula,... marking the first

time the highly-advanced jets have cruised the skies above Korea at the same time.

Other U.S. assets include two B-1B bombers and six Growler electronic warfare jets as

well as dozens of F-15s and F-16s.

South Korea has deployed 90 fighter jets, including its F-15 and FA-50 fighters.

North Korea condemned the drills on Sunday saying they could lead to an all-out provocation

that may lead to a nuclear war.

Running a commentary in North Korea's state-run Rodong Sinmun on Sunday,... Pyongyang said

"such a drill is a dangerous provocation as it's driving tension on the Korean peninsula

to the brink of a war",... and that both "South Korean and the U.S. puppet forces are foolish

to run amok with such stealth fighters."
